Membership Agreement
These Terms of Service (the "Agreement") constitute a legally binding contract between you and Tabletop Library, LLC ("TTL," "we," "us," or "our") regarding your membership and use of our facilities and services located in Berkeley, California. By creating an account and accepting these terms, you are electronically signing this Agreement, which is equivalent to a handwritten signature under the Electronic Signatures in Global and National Commerce Act (ESIGN Act).
1. Membership Benefits
As a paying member in good standing, you are entitled to the following benefits:
- Unlimited access to our venue during all regular operating hours
- 10% discount on all retail purchases made at Tabletop Library
- Guest pass allowance as determined in pricing plan
- Access to our extensive board game library during your visits
2. Subscription and Payment Terms
2.1 Billing Cycles. Memberships are available on a quarterly (3-month) or annual (12-month) billing cycle. Pricing is determined by your selected membership tier and billing frequency as displayed during the signup process.
2.2 Automatic Renewal. YOUR MEMBERSHIP WILL AUTOMATICALLY RENEW AT THE END OF EACH BILLING PERIOD UNLESS YOU CANCEL PRIOR TO THE RENEWAL DATE. You authorize us to charge your payment method on file for the renewal amount. You will receive email notification prior to each renewal.
2.3 Payment Processing. All payments are processed securely through Stripe. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge it for all fees incurred.
2.4 Failed Payments. If your payment method fails, we will attempt to contact you and retry payment. Your membership benefits may be suspended until payment is successful. If payment remains unsuccessful after multiple attempts, your membership may be terminated.
3. Cancellation and Refund Policy
3.1 Your Right to Cancel. You may cancel your membership at any time by contacting us or managing your subscription through your account settings. Cancellation will turn off automatic renewal but will not terminate your current membership period.
3.2 Access After Cancellation. Upon cancellation, you will retain full membership benefits through the end of your current paid billing period. No partial refunds will be provided for unused time within a billing period.
3.3 No Refunds. All membership fees are non-refundable. By accepting these terms, you acknowledge that no refunds or credits will be issued for partial months, unused guest passes, or early cancellation.
4. Eligibility and Account Requirements
4.1 Age Requirement. You must be at least 13 years old to create or use an account. Individuals aged 13–17 may only use the services if a parent or legal guardian is the primary account holder or has provided verifiable consent and agrees to these Terms and all payment obligations.
4.2 Parent/Guardian Consent and Responsibility. For users aged 13–17, a parent or legal guardian must: (a) create or link a primary account, (b) provide payment authorization where applicable, (c) accept these Terms on the minor's behalf, and (d) supervise the minor's use. The parent or legal guardian is responsible for the conduct, compliance, and charges of the minor and any household members included in the account.
4.3 Under 13. We do not permit accounts for children under 13. Children under 13 may visit the venue only as guests of an adult member and without creating an online account.
4.4 Account Accuracy. You agree to provide accurate, current, and complete information during registration and to update this information as necessary to maintain its accuracy.
4.5 Account Security. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4.6 Children's Privacy (COPPA). We do not knowingly collect personal information online from children under 13. If we learn that we have collected such information without verifiable parental consent, we will delete it. Parents or guardians who believe a child has provided personal information to us may contact us at the address in Section 14.
5. Liability Waiver and Assumption of Risk
5.1 Assumption of Risk. You acknowledge that participation in activities at Tabletop Library involves inherent risks, including but not limited to risks of personal injury, property damage, or loss. You voluntarily assume all risks associated with your use of our facilities.
5.2 Release of Liability. To the fullest extent permitted by law, you release, waive, and discharge Tabletop Library, its owners, officers, employees, and agents from any and all liability for injuries, damages, or losses that you may sustain while on our premises or participating in our activities, whether caused by negligence or otherwise.
5.3 Property Damage. You agree to be responsible for any damage you cause to our property, games, or equipment, whether intentional or accidental.
5.4 Family Member Liability. For family memberships, the primary account holder accepts full responsibility and liability for all household members' actions, injuries, and damages while on Tabletop Library premises.
6. House Rules and Code of Conduct
6.1 House Rules. All members and their guests must comply with our House Rules, available at tabletoplibrary.com/house-rules. The House Rules are incorporated into this Agreement by reference.
6.2 Community Standards. We are committed to maintaining a welcoming, inclusive, and respectful environment. You agree to treat all members, guests, and staff with courtesy and respect.
6.3 Termination for Violations. We reserve the right to suspend or terminate your membership immediately, at our sole discretion, if we determine that your conduct is inconsistent with our community values, violates our House Rules, negatively impacts other members' experiences, or otherwise makes you unsuitable for membership. In such cases, no refund will be provided for any remaining portion of your membership period.
7. Photo and Video Consent
7.1 Media Capture. From time to time, we may capture photos and videos at our venue for marketing, promotional, and social media purposes. By entering our premises, you consent to being photographed or recorded.
8. User-Generated Content
8.1 Your Content. You retain ownership of any content you submit through our platform, including profile information, photos, bios, event posts, and messages (collectively, "Your Content").
8.2 License Grant. By submitting Your Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute Your Content solely for the purpose of operating and providing our services to you and other members.
8.3 Content Standards. You agree that Your Content will not violate any law, infringe upon any third-party rights, or contain offensive, harassing, or inappropriate material.
8.4 Content Moderation. We reserve the right to review, monitor, and remove any content that violates these Terms or that we determine, in our sole discretion, is inappropriate for our community.
9. Intellectual Property
All content, features, and functionality of our website and services, including but not limited to text, graphics, logos, images, and software, are owned by Tabletop Library and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.
10. Privacy
Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, available at tabletoplibrary.com/privacy. By using our services, you consent to the collection and use of your information as described in the Privacy Policy.
11. Dispute Resolution and Governing Law
11.1 Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
11.2 Venue. Any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in the state or federal courts located in Alameda County, California, and you consent to the personal jurisdiction of such courts.
11.3 Informal Resolution. Before filing any formal legal action, you agree to first contact us to attempt to resolve any dispute informally.
12. Modifications to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a prominent notice on our website at least 30 days before the changes take effect. Your continued use of our services after the effective date of the revised Terms constitutes your acceptance of the changes.
13. General Provisions
13.1 Entire Agreement. This Agreement, together with our Privacy Policy and House Rules, constitutes the entire agreement between you and Tabletop Library regarding your membership and supersedes all prior agreements and understandings.
13.2 Severability. If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect.
13.3 Waiver. Our failure to enforce any right or provision of this Agreement shall not be deemed a waiver of such right or provision.
13.4 Assignment. You may not assign or transfer this Agreement or your membership without our prior written consent. We may assign this Agreement without restriction.
